RIF BIKES
TERMS AND CONDITIONS OF SALE, ASSUMPTION OF RISK & CUSTOMER ACKNOWLEDGMENT
By purchasing and accepting delivery of the electric bicycle (“E-Bike”) , electric moped or electric off-road bike, the Buyer acknowledges and agrees to the following Terms and Conditions.
1. CONDITION OF E-BIKE
The Buyer acknowledges that the E-Bike has been made available for inspection prior to delivery. The Buyer confirms that the Buyer has had a reasonable opportunity to inspect and, where permitted, test the E-Bike, or has voluntarily chosen to waive such inspection or testing.
At the time of delivery, except for any matter specifically identified in writing below, the Buyer acknowledges that no visible defect or known issue has been reported or observed.
If none: NONE KNOWN
The Buyer acknowledges receipt of the E-Bike in its present condition.
2. LIMITED WARRANTY
Any warranty provided with the E-Bike is governed exclusively by the separate RIF Bikes Limited Warranty & Maintenance Policy supplied with the E-Bike.
Except for the written RIF Bikes Limited Warranty and any rights that cannot legally be excluded under applicable law, Seller makes no additional warranties or representations concerning the E-Bike.
No employee, salesperson, dealer, representative, advertisement, oral statement, text message, social-media communication, or other communication may modify or expand the written RIF Bikes Limited Warranty unless the modification is expressly made in writing and authorized by RIF Bikes.
3. ALL SALES ARE FINAL — NO RETURNS / NO REFUNDS / NO EXCHANGES
ALL RIF BIKE SALES ARE FINAL.
Once the E-Bike has been purchased and/or delivered to the Buyer, RIF Bikes does not accept returns, refunds, or exchanges, except where expressly required by applicable law.
The Buyer acknowledges and agrees that there is NO RETURN PERIOD, NO TRIAL PERIOD, AND NO BUYER’S REMORSE RETURN POLICY.
The Buyer may not return or exchange an E-Bike because of:
* Change of mind or buyer’s remorse;
* Personal preference;
* Size, color, style, comfort, performance, range, speed, or riding characteristics;
* The E-Bike having been ridden or used;
* Normal wear and tear;
* Maintenance requirements;
* Wear items or consumable components;
* Damage caused by misuse, accident, neglect, improper maintenance, modification, overloading, or unauthorized use;
* Mechanical or electrical issues that are subject to repair or replacement under the applicable RIF Bikes Limited Warranty.
A WARRANTY CLAIM IS NOT A RETURN AUTHORIZATION.
The existence of a mechanical, electrical, battery, motor, controller, drivetrain, suspension, or other potentially warrantable issue does not automatically entitle the Buyer to return the E-Bike, receive a refund, or exchange the E-Bike for another bicycle.
If a defect qualifies for coverage under the RIF Bikes Limited Warranty, RIF Bikes will address the defect according to the remedies available under that Limited Warranty and applicable law, which may include inspection, diagnosis, repair, or replacement of the covered defective component.
Except where required by applicable law, the sale remains final even when warranty service is required.
By signing this Agreement, the Buyer confirms that the Buyer understands and accepts RIF Bikes’ ALL SALES FINAL / NO RETURNS / NO REFUNDS / NO EXCHANGES POLICY before completing the purchase.
4. ASSUMPTION OF RISK
The Buyer understands and acknowledges that operating an electric bicycle involves inherent and potentially serious risks, including but not limited to:
* Falling;
* Collision;
* Loss of control;
* Mechanical failure;
* Road hazards;
* Off-road hazards;
* Weather conditions;
* Other vehicles;
* Pedestrians;
* Animals;
* Terrain;
* Rider error; and
* Serious bodily injury or death.
The Buyer voluntarily assumes the ordinary and inherent risks associated with operating the E-Bike, including risks resulting from the Buyer’s operation, misuse, improper maintenance, modification, or use contrary to manufacturer instructions.
5. STREET MODE / OFF-ROAD OR RACE MODE
Where applicable, the E-Bike is delivered configured in its designated STREET MODE, subject to the specifications and legal classification applicable to the particular model and jurisdiction.
Where the E-Bike provides access to an OFF-ROAD, UNRESTRICTED, or RACE MODE, the Buyer understands that activating or operating such mode may cause the E-Bike to no longer qualify as a street-legal electric bicycle under applicable law.
RACE / OFF-ROAD MODE IS INTENDED FOR USE ONLY WHERE LEGALLY PERMITTED AND IS NOT INTENDED FOR OPERATION ON PUBLIC ROADS, PUBLIC BIKE PATHS, OR OTHER LOCATIONS WHERE SUCH OPERATION IS PROHIBITED.
The Buyer is solely responsible for determining whether and where a particular operating mode may legally be used.
The Buyer assumes responsibility for citations, fines, penalties, impoundment, claims, or other consequences resulting from operating the E-Bike in violation of applicable law.
6. SPEED AND POWER
Certain RIF models may be configured for street operation with programmed speed and/or power limitations, including configurations of approximately 25 MPH and 750 watts, where applicable.
Actual legal limits vary by jurisdiction.
The Buyer understands that changing controller settings, programming, speed limitations, power limitations, drivetrain configuration, or other operating parameters may affect the E-Bike’s legal classification, handling, reliability, warranty coverage, and safety.
Any such modification is undertaken at the Buyer’s own responsibility.
7. SINGLE-RIDER MODELS
Unless a particular RIF model is specifically identified and equipped by the manufacturer for passenger use, the E-Bike is designed for ONE RIDER ONLY.
The Buyer shall not carry a passenger on a single-rider E-Bike.
Carrying a passenger may:
* Exceed the design load;
* Reduce braking performance;
* Affect handling and stability;
* Increase stopping distance;
* Damage the frame, wheels, suspension, drivetrain, or other components; and
* Cause loss of control, serious injury, or death.
Damage caused by carrying an unauthorized passenger or exceeding the specified weight capacity is not covered by the Limited Warranty.
8. MAXIMUM LOAD
The Buyer shall not exceed the maximum rider, passenger, or cargo capacity specified for the particular RIF model.
The Buyer understands that accessories and cargo contribute to total vehicle load.
Damage resulting from overloading is not considered a manufacturing defect.
9. REQUIRED INSPECTION AND MAINTENANCE
The Buyer acknowledges that an E-Bike is a mechanical and electrical vehicle requiring regular inspection and maintenance.
Before riding, the Buyer should inspect the E-Bike for conditions that could affect safe operation, including:
* Brakes;
* Tires and tire pressure;
* Wheels and axles;
* Steering;
* Handlebars;
* Suspension;
* Chain and drivetrain;
* Cranks and pedals;
* Battery mounting;
* Motor mounting;
* Frame;
* Suspension pivots; and
* Accessible fasteners.
The chain and drivetrain should be inspected regularly and cleaned and lubricated as riding conditions require.
A comprehensive drivetrain inspection, cleaning, adjustment, and lubrication should be performed approximately every 100 miles, or more frequently following riding in rain, mud, sand, dust, water, or severe off-road conditions.
The Buyer shall not continue operating the E-Bike when a component is loose, damaged, cracked, excessively worn, improperly adjusted, or otherwise unsafe.
Damage resulting from continued operation after a problem becomes apparent may not be covered by warranty.
10. BROKEN CHAINS AND WEAR ITEMS
Chains, brake pads, tires, tubes, sprockets, chainrings, cassettes, grips, bearings, seals, and similar consumable components are subject to normal wear.
A broken, stretched, rusted, contaminated, improperly adjusted, inadequately lubricated, or worn chain is generally considered a maintenance or wear item rather than a manufacturing defect, unless inspection establishes a covered defect in materials or workmanship.
Consequential damage caused by operating the E-Bike with an excessively worn, damaged, improperly adjusted, or inadequately maintained drivetrain is not covered by the Limited Warranty.
11. ALTERATIONS AND MODIFICATIONS
The Buyer assumes responsibility for modifications made after delivery.
Damage caused by modifications, incompatible components, improper installation, unauthorized electrical alterations, altered programming, increased power settings, increased speed settings, or improper repairs is not covered by the Limited Warranty.
Modification of the E-Bike may also change its legal classification.
12. ALCOHOL AND DRUGS
The Buyer shall not operate the E-Bike while impaired by alcohol, cannabis, illegal drugs, prescription medication, or any other substance that adversely affects judgment, balance, coordination, perception, or reaction time.
The Buyer acknowledges that impaired operation substantially increases the risk of collision, serious injury, and death and may violate applicable law.
13. COMPLIANCE WITH LAW
The Buyer is responsible for understanding and complying with all laws applicable to the location where the E-Bike is operated, including laws concerning:
* E-Bike classification;
* Speed;
* Motor power;
* Registration;
* Licensing;
* Age restrictions;
* Helmets;
* Passenger restrictions;
* Lighting;
* Equipment;
* Roadway use;
* Bicycle-path use; and
* Off-road operation.
Laws and regulations may vary by state, municipality, trail, park, and other jurisdiction.
14. SAFE OPERATION
The Buyer agrees to operate the E-Bike responsibly and according to its intended use.
The Buyer shall not knowingly operate an unsafe or damaged E-Bike.
Protective equipment, including an appropriate helmet, is strongly recommended and shall be used whenever required by applicable law.
15. BUYER RESPONSIBILITY
To the fullest extent permitted by applicable law, the Buyer assumes responsibility for injury, property damage, citations, penalties, or losses caused by the Buyer’s:
* Negligent operation;
* Reckless operation;
* Misuse;
* Illegal operation;
* Failure to maintain the E-Bike;
* Unauthorized modification;
* Overloading;
* Passenger use contrary to manufacturer specifications; or
* Operation while impaired.
16. RELEASE AND LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, the Buyer releases and holds harmless Seller from claims arising from the Buyer’s misuse, negligent operation, unauthorized modification, failure to maintain the E-Bike, violation of applicable law, or operation contrary to written safety instructions.
Nothing in this Agreement is intended to waive or limit liability that cannot lawfully be waived or limited, including any rights or remedies available to the Buyer under applicable consumer protection law.
17. THIRD-PARTY CLAIMS AND INDEMNIFICATION
To the fullest extent permitted by applicable law, the Buyer agrees to indemnify and hold Seller harmless from third-party claims, losses, damages, costs, and reasonable attorney’s fees arising from the Buyer’s unlawful operation, misuse, unauthorized modification, negligent maintenance, or operation of the E-Bike contrary to the instructions provided by Seller or manufacturer.
18. NO ORAL MODIFICATIONS
The Buyer acknowledges that statements made orally by employees, salespersons, independent dealers, or other persons do not modify these Terms or the written RIF Bikes Limited Warranty.
Any modification must be made in writing by an authorized representative of RIF Bikes.
19. SEVERABILITY
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.
20. CUSTOMER ACKNOWLEDGMENT
By signing below, the Buyer acknowledges that the Buyer:
1. Has read and understands these Terms and Conditions;
2. Has received or been provided access to the RIF Bikes Limited Warranty & Maintenance Policy;
3. Has had an opportunity to inspect the E-Bike;
4. Understands the maintenance requirements;
5. Understands the risks associated with operating an electric bicycle;
6. Understands the difference between street operation and off-road/race operation where applicable; and
7. Accepts responsibility for lawful and safe operation of the E-Bike.
