E-Bike Terms and Conditions

 TERMS:  The Buyer acknowledges and agrees that the e-bike is sold in "AS IS," "WHERE IS," and "WITH ALL FAULTS" condition. The Seller has not made, does not make, and specifically disclaims all representations or warranties of any kind, whether express or implied, including, but not limited to, any implied warranty of merchant ability or fitness for a particular purpose.  The Buyer confirms that they have had the opportunity to inspect and test the e-bike to their full satisfaction or knowingly waived the right to do so.  The Buyer agrees that they are not relying on any oral or written representations, statements, or inducements concerning the e-bike's condition, functionality, or performance, other than what is explicitly stated in this written agreement.   The Seller hereby discloses the following known issues or defects with the e-bike:  The Buyer acknowledges awareness of NO ISSUES and NO DEFFECT and accepts them as part of the "as-is" condition of the sale.   The Buyer acknowledges that riding an electric bike involves inherent risks of personal injury or death. In consideration of the sale of the e-bike, the Buyer agrees to:  The Buyer voluntarily assumes all risks and liability for any damages, injuries, or losses, known or unknown, which may arise from the USE or MISUSE of the purchased e-bike beginning at the date of sale.  The Buyer acknowledges and agrees that purchased e-bike is sold in STREET mode with limits of 25 mph speed limit and 750W motor power. Switching operation of the e-bike to RACE mode will be done solely based on Buyers OWN risk. Therefore Buyer acknowledges and agrees that Race mode is strictly for off road use only.    Buyer acknowledges and agrees that purchased e-bike is single-rider model. Also, said purchased e-bike is not built to handle the extra weight of a second passenger. Purchased e-bike lacks the proper frame strength, motor power, and braking capacity needed for safe two-person riding. Trying to carry a passenger or cargo on a single-rider model can damage the bike and lead to an accident.  The Buyer agrees to obey all applicable local, state, and federal laws, rules, and regulations regarding the operation of the e-bike, including traffic laws , safety gear and helmet requirements.  Buyer acknowledges and agrees that the consumption of drugs or alcohol while riding an e-bike is a dangerous, illegal and prohibited act that impairs crucial skills like balance, coordination, and reaction time, leading to increased risks of injury and/or accidents.  The Seller is not taking any responsibility for any accidents or injuries that might occur when riding purchased e-bike.    The Buyer hereby releases, waives, and forever discharges the Seller from any and all claims, demands, or causes of action of any kind, whether known or unknown, foreseen or unforeseen, that may arise as a result of the sale or use of the purchased e-bike.  The Buyer agrees to indemnify and hold the Seller harmless from any litigation expenses, attorney fees, financial losses, any liability, health expenses or damages that the Seller may incur as a result of any claim made by the Buyer or a third party related to the purchased e-bike.  The Buyer acknowledges and agrees that ALL SALES ARE FINAL. There are no returns, refunds, or exchanges for any reason, including any mechanical or electrical issues that may arise after the sale.
